Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Project Engineer application, website, and related services (collectively, the "Service"). By accessing or using Project Engineer, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Nature of the Service

Project Engineer provides engineering calculators, computational tools, visualisation utilities, and related informational resources. The Service is provided for informational and convenience purposes only. The Service does not provide professional engineering advice, certification, validation, approval, or compliance assessment.

2. No Professional Advice; Accuracy and Error Reporting

The outputs, calculations, diagrams, and results generated by Project Engineer are automated computational outputs that may rely on user-supplied inputs, may contain errors or assumptions, may not reflect site-specific conditions, and may not comply with applicable standards or codes.

Project Engineer takes no responsibility for any results produced by the Service. You are solely responsible for independently verifying that all outputs are suitable, correct, and appropriate for your intended use before relying on them in any capacity. You must apply appropriate professional judgement and consult qualified professionals where necessary. Project Engineer expressly disclaims any and all liability arising from reliance on the Service.

To the maximum extent permitted by law, neither Project Engineer nor its sponsors, endorsers, or the independent or verifying engineers who review, validate, or endorse any calculator or content within the Service accept any liability whatsoever for any inaccurate, incomplete, or incorrect results, outputs, or information produced by the Service. All results are provided for informational purposes only and must be independently verified by a suitably qualified professional before being relied upon.

If you identify an inaccuracy, error, or incorrect result in any calculator or content, you may report it to Project Engineer using the in-app contact form. Where a reported issue is found to be valid, Project Engineer will make reasonable efforts to correct it and release an updated version of the application. Reporting an inaccuracy does not create any liability on the part of Project Engineer, its sponsors, endorsers, or verifying engineers, and no specific timeframe for review or correction is guaranteed.

3. Subscription Plans and Pricing

Project Engineer offers multiple subscription tiers: Free, Pro, and Premium. The Free tier provides access to a limited set of engineering calculators and a limited number of saved results. The Pro and Premium tiers provide access to additional calculators, features, and services as described in the application at the time of purchase.

Subscription pricing is displayed in the application and may vary by region, currency, and platform. Project Engineer reserves the right to change pricing at any time. Price changes will not affect the current billing period of existing subscribers but will apply upon renewal.

4. Billing, Payment, and Auto-Renewal

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected) and are processed through the Apple App Store, Google Play Store, or Stripe, depending on your platform. By subscribing, you authorise the applicable payment provider to charge your chosen payment method at the start of each billing period.

Subscriptions auto-renew at the end of each billing period unless you cancel before the renewal date. You may manage your subscription and turn off auto-renewal through your device settings (Apple App Store or Google Play Store) or through the Subscription screen within the application. Cancellation will take effect at the end of the current paid billing period, and you will retain access to paid features until that date.

5. Free Trials

Project Engineer may offer free trial periods for paid subscription tiers from time to time. If you begin a free trial and do not cancel before the trial expires, your subscription will automatically convert to a paid subscription at the applicable rate. The duration and availability of free trials are at the sole discretion of Project Engineer.

6. Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. After that date, your account will revert to the Free tier. No partial refunds are issued for unused portions of a billing period.

7. Refunds

Refund policies are governed by the platform through which your subscription was purchased. For subscriptions purchased through the Apple App Store, refund requests must be directed to Apple. For subscriptions purchased through the Google Play Store, refund requests must be directed to Google. For subscriptions purchased via Stripe, please contact us at the email address below and we will review your request on a case-by-case basis. Project Engineer does not guarantee refunds and is not responsible for refund decisions made by Apple or Google.

8. Account Deletion and Subscriptions

If you delete your Project Engineer account while you have an active paid subscription, your subscription will be cancelled and your account data will be permanently removed. You will forfeit any remaining paid access. To avoid being charged after account deletion, you must also cancel your subscription directly through the Apple App Store, Google Play Store, or Stripe before deleting your account. Project Engineer is not responsible for charges incurred after account deletion if the subscription was not cancelled through the payment provider.

9. Warranty Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Project Engineer does not warrant that the Service will be uninterrupted, error-free, secure, or free of defects.

10. Limitation of Liability

To the maximum extent permitted by law, neither Project Engineer nor its sponsors, endorsers, or verifying engineers shall be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to economic loss, loss of profit, loss of data, project delay, construction defects, structural failure, or regulatory non-compliance, even if Project Engineer has been advised of the possibility of such damages.

If liability cannot be excluded under applicable law, it is limited to the amount you paid to Project Engineer in the twelve (12) months preceding the claim, or the minimum amount permitted by law, whichever is greater.

11. User Responsibilities

You agree to provide accurate input data, independently verify outputs, use the Service in accordance with applicable laws, and not misuse, reverse engineer, copy, or redistribute the Service. You remain responsible for compliance with engineering standards, regulatory requirements, and professional obligations.

12. Acceptable Use

You must not use the Service to engage in any unlawful activity, attempt to gain unauthorised access to the Service or its infrastructure, interfere with or disrupt the integrity or performance of the Service, transmit any malware, viruses, or harmful code, impersonate another person or entity, or use the Service in any manner that could damage, disable, or overburden Project Engineer's systems. You must not attempt to circumvent subscription restrictions, access paid features without a valid subscription, or share account credentials to avoid subscription fees. Project Engineer reserves the right to suspend or terminate access for any user who violates this section.

13. Accounts

If you create an account, you are responsible for maintaining confidentiality of login credentials and all activity under your account. You may request deletion of your account at any time. Project Engineer may suspend or terminate accounts that violate these Terms. Subscriptions are tied to your account and are non-transferable.

14. Termination

Project Engineer may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. If your account is terminated by Project Engineer for a violation of these Terms, you are not entitled to a refund for any remaining subscription period. You may request export or deletion of your data prior to termination by contacting us. Sections of these Terms that by their nature should survive termination shall remain in effect, including but not limited to warranty disclaimers, limitations of liability, and indemnification.

15. Indemnification

You agree to indemnify, defend, and hold harmless Project Engineer, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your reliance on any output or result generated by the Service.

16. Service Availability

Project Engineer does not guarantee that the Service will be available at all times. The Service may be subject to interruptions for maintenance, updates, or factors beyond our control. We will make reasonable efforts to minimise downtime but accept no liability for periods of unavailability. Subscription billing periods are not extended due to service interruptions.

17. Third-Party Services

The Service relies on third-party infrastructure and payment providers including Supabase (authentication and database), Cloudflare (hosting and security), Resend (transactional email), RevenueCat (subscription management and in-app purchase processing), Apple App Store (iOS in-app purchases), Google Play Store (Android in-app purchases), and Stripe (web payment processing). Your use of the Service is also subject to the terms and policies of these providers. Project Engineer is not responsible for the actions, availability, or policies of third-party services, including their handling of payment information.

18. In-App Purchases

Subscriptions purchased through the Apple App Store are subject to Apple's terms and conditions, including Apple's auto-renewal and cancellation policies. Subscriptions purchased through the Google Play Store are subject to Google's terms and conditions. Project Engineer does not directly process or store payment card details for in-app purchases; all payment processing is handled by the respective platform. You are responsible for any applicable taxes associated with your subscription.

19. Intellectual Property

All intellectual property rights in the Service, including source code, interface design, branding, logos, text content, and calculative structures, are owned by Project Engineer unless otherwise stated. You may not copy, reproduce, modify, distribute, or create derivative works without written permission. A subscription grants you a personal, non-exclusive, non-transferable, revocable licence to use the Service for the duration of your subscription period.

20. Feedback and Contributions

Project Engineer is continually improved with input and feedback from its users. We welcome all feedback, suggestions, bug reports, feature requests, and other contributions. By submitting feedback, you grant Project Engineer a non-exclusive, royalty-free, perpetual, and irrevocable licence to use, modify, and incorporate your feedback into the Service without obligation or compensation.

21. Modifications

Project Engineer may modify the Service, subscription offerings, or these Terms at any time. If material changes are made to these Terms or to subscription pricing, we will make reasonable efforts to notify you, such as through an in-app notice or an update to the effective date. Continued use of the Service following any changes constitutes acceptance of the updated Terms.

22. Dispute Resolution

Project Engineer takes no responsibility for any results produced by the Service. Users shall independently verify that all results are suitable and correct before relying on them. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to the courts of New South Wales, Australia, unless otherwise required by applicable consumer law in your jurisdiction.

These Terms are governed by the laws of New South Wales, Australia, unless otherwise required by applicable consumer law.

24. Sponsorships

Project Engineer offers paid sponsorships that allow a business to be featured on one or more calculator screens. Sponsorships are separate from user subscriptions and are billed monthly through Stripe.

Where a fixed duration (for example, a number of months) is selected, the sponsorship runs for that term and then ends automatically. Where no fixed end is selected, it continues on a monthly basis until cancelled.

You may cancel a sponsorship at any time through the billing portal accessible within the app. Cancellation takes effect at the end of the current paid billing period: the sponsorship remains active until that period ends, future renewals are stopped, and no refund or proration is issued for the current or any prior period.

You are responsible for the content you submit for a sponsorship, including your company name, logo, website link, and any other materials, and you warrant that you have the right to use them. Approved sponsor information (such as company name, logo, and website) is displayed publicly within the app.

Project Engineer may, at its sole discretion, approve, decline, suspend, or remove any sponsorship or sponsor content — including for inaccuracy, unlawfulness, or unsuitability — and may do so without refund where these Terms have been breached. Sponsorship does not constitute endorsement, and neither Project Engineer nor its sponsors, endorsers, or verifying engineers accept liability for sponsor content or for any results produced by the Service.
